value of the ground is small, as it could not be sold for build-

ing purposes. The route lies through a portion of the Public

Gardens, but it is not anticipated that the Gardens will be

injured thereby to any appreciable extent.

I understand that the tramway will be worked

on the same system as the present high-level tramway, but no

details of its working have as yet been laid before me. It

will, I believe, fill a want which the existing tramway does

not satisfy; as the numerous new houses now existing in the

neighbourhood of the proposed route are badly situated with

respect to the existing line, which is not used by their

occupiers to any considerable extent. It will also be a great

advantage to the general public to have the lower terminus

situated on the level of Queen's Road. For these reasons, and

in view of the great development of the Peak as a residential

quarter and the consequent congested state of traffic on the

present tramway, I am strongly in favour of permission being

given for the construction of the new line.

Mr. Findlay Smith has already signified

his willingness to accept the terms referred to in paragraph

2, and has requested permission to instruct Counsel to prepare

the Draft Bill which it will he necessary to introduce into

Legislative Council when I have been informed of your approval

of the scheme. I should therefore be glad to be informed by

telegraph whether you are prepared to sanction the introduction

of such a Bill, embodying the conditions outlined in this

Despatch, and generally making provision for the proper

construction,
